My fiance got divorced, and I dont want the same last name as her, but I want his last name, is there any way he can have her change her last name? Like can he go ask his lawyer or the judge?

If the divorce wasn't final, then you can request (in the divorce decree) that she change her name. But, it isn't a guarentee. If their divorce is already final, then you are out of luck. This is true for the U.S. However, some European countries (France is one of them) will make the woman change if the husband requests it.

You might want to consider the two of you (you and your fiance) both changing your last name when you get married....or keep your maiden name if you really can't stand the thought of sharing one with her.

Returning to a maiden name (or any other name) is included in the divorce proceeding, if requested. However, it is not required that people change their names after divorce and a woman who changed her name for her husband's surname can continue to use it if she wants to.

Unfortunately for you, you are just going to have to deal with it.

The only other option that I can think of is that your Husband can change his last name and then when you are married, you will have his "new" last name. The downside to this is that when you have children, there won't be any family tree (according to the new last name) and then that turns into a complicated and messy issue in trying to explain to a 4 year-old why Grandpa & Grandma have a different last name as Mommy & Daddy.

Same situation, but in the divorce, he's asked for her name to br returned to it's maiden form. I know EXACTLY how you feel about not wanting the same name as "her" (and I agree with you 1,000,000% as far as not going to have the same name as that woman.)

As for people saying that this feeling is childish...SO WHAT?!
I don't think you are in "our" shoes, and if you were dealing with a royal C*nT of an ex of your man's...you might understand our feelings and wouldn't be so quick to judge.

Why should it bother you? I have recently divorced and I am keeping my ex's last name because I have children with that name. I guess you will have to decide what is more important - marrying this man or getting one up on her.

I can understand since you may have a dislike for her but aside from her getting remarried there is little you can do . Unless of course she holds the same feelings about you then she may decide to change her last name.

Yes he could have ask for it in the divorce, but it may be to late to have it changed. I would ask my lawyer he would know.

it shouldn't bother you that the still has his last name. YOUR the one he loves now, she is the past.

and no you can't make her change it if she doesn't want to. name changes cost money, you could have your fiance offer to pay for half (or all) of the name change and see if she'll go for it.

Instead of pressing her to change her last name, why don't you guys combine yours 2 last names into one name which you will use as your married name. For example your name is Smith , his name is Olsen, combined name Smith-Olsen a lot of people even very famous do it.
