my ex has claims now for full custody of the children he never pay the maintainance for. he has full access to his kids, they visit him during holidays etc. we have a court hearing now in London UK. the social services are now doing section 7 investigating, which means the kids will be asked who do they want to reside with? My concerns are if the kids choose him over me what will happen, because my ex is a very manipulative man, he brain wash the kids that it will be heaven living with him as they will be eating fast food everyday and choose to go to ben anytime they like!!! will the court make decision based on what the kids says or will they look at other evidence before taking the kids away from me?

These aren't people that've been dragged from the street, they will look at all situations & decide what to do! If they went only by what you're children decide that'd be stupid as it would mean the parents trying to win one over on the other therefore making promises to children which will no doubt be broken! Your ex has dragged you & your children through all of this, your children will remember this & once they are older they will come to realise he's not so great after all. The children need their mother & even your ex knows this, he's just trying to make your life difficult & it seems he's succeeding.

My parents split when I was very young & me along with older siblings stayed with our dad but that was my parents' choice. To be honest I don't have many memories from when I was younger, I have one just after my mum left, my dad bought us an ice cream from the shop, that's it (apart from a few silly ones). No matter what happens just make sure your children have plenty of happy memories, I feel sad that I don't have any!

Sorry to read this. This is what typically happens to men in America cept that women automatically get the children. You have been a great mommy as many women here don't let
daddies see or even talk to their children.

Kindly go to Yahoo groups & join some women's or divorced groups. You will get all the info you need there. You can also google this. Good luck you sound like a caring individual & I hope you get justice.

What "evidence" do you have? You had better come up with some good stuff if you want to keep them

In the US the woman has a HUGE advantage as the courts are biased toward the mother.

sounds like my life.....i let my kids go live with their dad 2 yrs ago...they were 13 and10....he told them there would be no rules and how much they were going to do and have sooo much fun....that was a big joke....now as we speak im going thru getting them back because they hated living with thier dad...he did nothig for them and never went anywhere,,,it was a bad situation...they begged to come back and take them from him....total mess,,,,,if they are older than 12.. and they realize whats all going on...let them read this so they wont believe all that crap....they will say anything to the kids to get them to choose him....they will be so sorry if they go and it will be a fight to get them back.....I hope they dont beleive what thier dad is saying......if they are younger than 12....they will most likely let them stay with you. i think it will depend on the age of your kids and they will probably ask them why they want to stay with the parent they pick. social services will look at all evidence as well. hope everything goes well for you

All depends on the age of your children. Also, they look at whether he can provide a home environment for the children.

well that depends on how old the kids are....
over the age 13 they will listen to the kids but under they will look at the whole issue....
you need to get as much dirt on him as you can, that always helps...
