She was caught selling drugs to an undercover cop & is going to jail for 6 months. We wanted to take him with us ( hopefully for good ) Child protective svc. is involved. We have been waiting to hear from them. Well , we did today. Because the boy ( who's 14 & wouldn't say anything bad about his mother because they questioned him in front of her) was not with her when she sold the drugs, she's still a fit mother & will regain custody when she gets out of jail. While she is in there, she has asked her brother to take him. ( He is a dope smoker, among other things ) Child Protection said we have to have her permission to take him. ( she already said no cuz she knows we'll file for custody) Is there anything we can do? We really need to get this kid out of that enviornment. Thanks for any help. We have been together 9 yrs. & have 2 other children.

as the legal parent he should be able to go to court and get custody of the child. file for visitations and then file for custody. when filing for custody the courts will take into consideration the time she did in jail and her record after but do not stop fighting

That's odd. Child protection is not supposed to question children in front of a parent. You can still file for custody but I really suggest getting married..you have a better shot.

Your best choice would be to contact an attorney. I am sure there are other avenues that you could take. You also need to consider your other children. If the 14 yr old thinks that environment is fine(drugs ect..) he may also be doing drugs or lord knows what else. Just be well informed and be ready for lots of issues. Any 14 yr old can be very difficult, he may have many extra problems due to his upbringing. Good Luck.

The childs biological father has rights before an uncle no matter what the mother says. she loses her rights the moment she gets arrested. Contact a lawyer, go to the the court, stay away from Child Protective Services. Any judge would grant your boyfriends motion for custody against hers as long as he is fit.

If you care about the boy your best course of action is too help the mother seek help for her addictions. At fourteen the boy has his own mindset and even if you could succeed at what you are trying to do it would only make the boy bitter against you for taking his mother away from him.

I think this question would be best suited for an attorney - someone who knows the laws applicable in your city and state. Not a bunch of internet strangers.

You need to get custody, but the problem is most states will always side with the mother, dad's don't stand a chance. My son lives with his meth addict Mother & I have tried & tried & can't do a thing.

he gets visitation and maximum in all probability joint custody. Your critiques of his stability do not count selection in basic terms the judges. in case you have information you may carry them up in court docket, unproven accusations will in basic terms paintings against you.
