Why do people on here think anyone of us knows the laws in any particular state? We are all ordinary people who are on here to answer questions and have fun. We don't know the legalities in your state. Contact a lawyer. It isn't like you could take what someone says on here to court anyways. I can hear it now.........Your honor I was told on Yahoo Answers that it is illegal for my wife to take my pension. Come on! This is so annoying.

To Jewells ... Ontario is a province, not a state ... this one's easy ... Yes, it's considered income ... and if she has a really good lawyer she can sue for POTENTIAL income, beyond what you make, if she can prove you're just riding the whole WCB gravy train. GOOD LUCK!!!!
