garnish your wages? And also I have to file bankrupcty with in the next month or so , how will that work with ch 13 ?

Just apply the cash advance company to your chapter 13 tell your attorney and tell them your are filing a chapter 13 (the cash advance company and when you file they are not allowed to call you or bring a lawsuit against you because the Chapter 13 trustee will pay them soem money but not the whole 400$

If you file bankruptcy, the cash advance company will become one of your creditors dealt with in the bankruptcy plan. This should be the case even if their suit against you results in a judgement before the bankruptcy filing. Your bankruptcy attorney will know this.

If it's gone to suit, they already gave you time to pay. However, they may still be interested in calling it off to save some court fees, but maybe not. You have to ask them.

I heard Dave Ramsey deal with something like this on last night's show. State laws may come into play. Speak to an attorney about this before taking any specific action.
