No you do not!!! On income support you are covered under the old Legal Aid scheme, now known as the CLS. If you go onto google and type in cls or community legal service in the search box, make sure if you are in the UK it is set to the UK pages only, press search and this will take you to there page. You type in your details and they can tell you there and then if you qualify.

Right forget the first answer.
At the moment you two split your finances could be said to have split. You might get away with some expenses on the kids if he really is paying no child support but on the whole any judge will have no truck with you running up debts and claiming them as joint.
Divorces are cheap and relatively straightforward.
Yes you may have to pay if he is not going to but any settlement would probably see you better off than you are now so balance out any outlay.
You can divorce him without his consent because you have been separated for over 5 years. Really in your instance I can see no reason why you should not do it. You will get your share of any assets and will get some form of payment started which cshould be back dated.

Well, quite honestly, he is not your ex yet. If he is content still being married, and you are the one wanting a divorce, you may have to pay for it. There are factors to be considered however, like, did he cheat, and has he been helping with the support of the children since you stopped living together? Sometimes who pays, is not settled until divorce is granted. Then the judge can order him to pay your attorney also. At any rate, it's not a picnic, by any means. Best of luck to you.

I hope you have had your support adjusted to reflect the changes in his income. Most states will do a reevaluation every two years but it has to be requested by one of the parties. Also since he is still legally married and you have custody I suggest you talk to a tax representative. He should be filing his taxes as Married filing separately and I believe you get to file as head of household. As for who pays for the divorce talk to a lawyer, your ex should be responsible for at least half, maybe more but a judge will determine that. Good luck.

the best thing you can do is go see a solicitor but if you are not earning you need to go and apply for legal aid don't worry the only thing he is doing is trying to frighten you so tell your old man to go run and jump he doesn't know what he is talking about he will have to pay so the best thing you can do is do as i say go and get proper legal advice and put your mind at rest seeing a solicitor wont cost you anything if you are on low income legal aid will pay for that so don't let your old man worry you they thing they know it all but they don't so go and get it sorted and don't worry take care good luck

If you are on income support then you are eligible for legal aid, so you may as well get down to a solicitor who does legal aid family work and issue divorce proceedings against him.

If you are in receipt of Income Support you will be eligible for public funding. Find a local solicitors who specialises in family law and who has a LSC franchise (Legal Aid). You can find this on-line via the Law Society's website.

I think he should pay since he makes so much money.. Does he help you with child support? My fiance is paying for his divorce and he been separated for over 10 yrs from his ex wife.. It can get quite exspensive..Try talking to a legal aid lawyer or any lawyer just to ask for advice..
