Is sexual assault a serious offence? even if you didnt do any thing except you sent an air kiss to a girl, and what are the charges and what is the worst thing that could possibly happen to you, if you were convicted.

There is no society on earth that would consider an air kiss sexual assualt. If it was meant as threatening, sarcastic or offensive then you should feel ashamed but I think you're in the clear Law wise.

Just in case this is a serious question, here is a serious answer.

Sexual Assault is a very serious offence, the maximum penalty (UK) on first conviction of an adult is 10 years imprisonment.

However;

What you describe is not a sexual assault. Section 3 of the Sexual Offences Act 2003 defines sexual assault as intentionally touching another person in a sexual way where that person does not consent to being touched in that way and you do not reasonably believe that they do consent.

An 'air kiss' is I believe usually a friendly gesture or a sarcastic one. Either way, they offence lies in the intention of the kisser and the perception of the kissee.

If it is part of a course of conduct towards that person which is intended to cause harrasment or which he knows or ought to know amounts to the same it is the offence of Harrasment - Section 2 of the Prevention of Harrasment Act 1997. A maximum of 6 months imprisonment and brings with it a number of powers (injunctions) to prevent the nuisance returning.

If, on the other hand, it was a one-off, innocent act without malicious intent and you can demonstrate this fact then the law as has been said 'does not concern itself with trivial things' - De minimis non curat lex.

As for assault. That can be comitted without touching a person but it requires the victim to be 'put in fear of immediate unlawful violence' I think you are safe from this charge on the facts given.

Sexual assault is a very serious offence if it is done by a man to a woman. If it done by a woman to a man however, then the same women who are so quick to criticise men tend to think it funny and acceptable. I have been touched in an intimate place by several women over the last two years and the female instigators of this form of sexual assault think they have a God given right to do it because they are women. When a man does it to them they make a big deal out of it. Why the double standards, the gender bias and the hypocrisy? I would never be ungentlemanly enough to do that to a woman.

In England, if the complainant considers any action to be an assault, they can make a complaint. It does not matter if the average person regards this as silly, it is construed to be in the mind of the complainer. THIS IS A DAFT LAW. Assault should not be on how the aggrieved person feels, but how the "woman on the Clapham omnibus" feels constitutes an assault.

Therefore, it does not depend on the offence but the importance of the person making a complaint. In England, people are locked up on the word of the complainant, if the complanier is important enough. This is the class system in operation.

It happens when a woman gets fed up and wants to ditch her man. She can then make malicious complaints to the Police to save her marriage (= meal ticket).

Women politicians do it w as well when they they want to silence opponents, make up claims of assualt etc. They will do this even if they are the ones doing the assaulting. It has happened and has been well documented.

Do you mean to tell me that "blowing a kiss" is now considered "sexual assault"?

You must be kidding.
In the same category as rape?

Worst thing that could happen is blowing a kiss would even get you, or any guy in trouble.
Where do you live?

Afghanistan? Iran? Syria?

In those county's, the worst punishment
is chopping your head off.

An "air kiss" wouldn't be considered a sexual assault.

I would have thought a sexual assault would involve some sort of physical contact and yes, it would be considered a serious offence.

The worst thing that could happen would be prison, I would suggest, and the other prisoners aren't very sympathetic to sex offenders!

Must be more than an innocent air kiss to be sexual assault. Depends on age, history, circumstances. If guily this is a very serious offence with a custodial sentence

Air kisses can not normally be construed as a sexual assault. However this can depend on the context, were they just a bit of fun or, put together with other circumstances, did they appear threatening?

Some people consider that 'an invasion of their space' (and that space, the depth of it varies by both culture and the individual) as something of 'an assault on their person.'

As for the subsequent event from a conviction! Well, the girls family could, for example, seek to extract a revenge on you, which could take on any number of forms. Which ever you consider to be the worst ~ could well be what they see as 'thee most fitting for you.'

Just be a good lad and don't push your luck. Someone could take advantage of you ...and push back.

PS: 'Assault' used to simply mean, 'taking a swing at someone,' the 'connection' of that swing would be 'Battery.' I'm unsure as to the Legal definition today.

if you assaulted some one you could get life, if you blew a kiss, a judge will laugh it out of court, whilst i dont condone unwanted attention, (everyone needs their space ) if you only blew a kiss, the the person that is making the allegation is a fool, and a petty one at that, what happens when they get whistled at in the street, 999, if you havent made any remarks,or advances before then their is no case for harrasment, if you touched this person or have kept making remarks of a sexual nature, then you need locking up.
