Do you think that it is discrimination for an employer to terminate an employee for smoking cigarettes, after all people who smoke are human beings too. Just like if, someone were to get fired because of race or religion it is considered to be discriminatory (because they are human beings).

If I were to get fired for that is it possible that could I use that as my case and sue for lost wages?

does the code of conducts mention anything about not smoking?? it could be rules rather than racial stuff!

For any kind of discrimination you can file a sue but as fas as some is fired for smoking only. If it is clearly mentioned in the Employee Hand Book or HR Manual or any Policy regarding smoking of workplace and smoking is probited. And in policy if they clearly mentioned action to be taken against the poeple who smoke at workplace. If they follow the process to fire someone according to the policy the it is ok. You can also refer to you loca laws about this issue, if there is a little flexibility they go to the court.

I don't know, maybe maybe not. I would not consider it as discrimination... I would consider that as a simple way of following the rules, after all if you don't follow the rules (in case of a cigarette which is completely not discriminative) then you deserve to be fired. So no, not a discrimination case in here...

personally i dont think its discrimination. i get the employer is not head over heels in luv wit smoking. but that does not translate to discrimination.the question u want to ask is: if its race/sex, then their is proof that u r capable.and due to shallow reason u r being targeted.
but,
dear, not smoking.smoking is dangarous to health.in a court he could claim he fired u 4 public safety!

well... it depends like if they were smoking when they werent supposed to be smoking then no its not discriminatory, just like if a school teacher was trying to convert their students to their own religion, when they know theyre not supposed to be

IT IS NOT DISCRIMINATION BECAUSE A SMOKER IT IS AN OPTION THAT YOU HAVE AND IT IS NOT SOMETHING LIKE RACE OR ANYTHING THAT YOU JUST CAN HELP IT
