I live in CA and the landlord next door and I both agree that we need a new fence. The existing fence is made of wood. I want to replace it with a cinderblock wall but my neighbor wants to stick with wood. He rents this property out and wants to spend as little money as possible. He will not back down. If he erects the fence without my approval am I responsible for half of the costs even if I never agreed to it?

YOU are responsible for any fence built on your property; HE is responsible for fence built on his property. So, if he and you do not agree, he must build his fence on his property (and he is solely responsible for cost). But, you would still be stuck with an ugly fence, unless you build your own.

If you do not come to an agreement, be sure to place your objection, in writing, so that when it gets REALLY messy, and you tell him to remove the fence from your property, your objection will be noted (he will argue that you agreed, etc.).

First of all, you want to check the laws in your area. Where I live in VA, a man is actually dead and his neighbor acquitted ! of murdering him, tho all acknowledge he was the shooter. The dead man was in his 70s! The disupte was over a fence - and a bull. But the fence was the biggie - under VA law, neighbors MUST SHARE the cost of fencing in certain conditions - and the shooter put in the most expensive fencing possible.

For myself, it's hard to imagine a cinder block wall looking anything but depressing. Are you sure it's money or is it aesthetics?

Certainly not. Sometimes neighbors agree to go halvsies on bordering fences, but it is not their obligation to do so. If he chooses to erect the fence, it must be on his property and he is responsible for the charges.

Just make it clear to the other party that you need to agree on a fence or that the other party is welcome to put the fence on their property (as opposed to the shared border) and pay for all of it. You can also go to Project sentinel and find out more information,

Make a fence of your own but it must be within your lot so that you will have no problem with the fence of your neighbor.

as long as nothing is in writing between you two about sharing the costs.....its all out of his pocket.

but do look into the laws of your area about fences and property lines. here in ohio they must be like 4 ft from the property line. least if he puts up wood alone you can have him shift it back some allowing room in time for your concrete wall.

He puts his fence on his property, you put your fence on your property. You each pay for your own fence.
