Employee provided an Employer Identification Number instead of a social security number. Can we suspend his payments until he provides a valid social security number?

Unless s/he has signed a waiver, the employer cannot withhold wages due.

Use the EIN as a SSN and inform the employee that until s/he presents a valid SS card, or a verified copy of an application for SSN s/he is suspended from work. (Without pay )

I think yes- though I was self employed and my employee number was my SSN or is- as I am still Self Employed and hired
as a sub contractor or freelancer. Make sure that is not the case....Actually, I think you should pay them if they are acting in good faith and hold back the amount to SSN-maybe not work them unti its solved.
