Actually the moon and Earth orbit each other, and together they both orbit the sun as the "Earth-moon system"

Added: "It is the center of the earth-moon system, rather than the center of the earth itself, that describes an elliptical orbit around the sun in accordance with Kepler's laws. It is also more accurate to say that the earth and moon together revolve about their common center of mass, rather than saying that the moon revolves about the earth. This common center of mass lies beneath the earth's surface, about 3,000 mi (4800 km) from the earth's center."
