up appointments,but after the surgery he felt like he still had the hernia. He went back again and the doctor told him to give it time to heal. Well months went by and he still felt the same thing. He told the doctor he didn't think he had fixed the hernia. The doctor referred him to another doctor and the 2nd doctor told him he had a totally different kind of hernia than the 1st one said he had. We no longer have insurance and his new job is very strenuous. He couldn't take the time off that he would need to heal and we could never afford to pay for this surgery on our own. I feel like this is the doctor's fault and my husband should be compensated for having to go through this surgery again. Everyone seems to think that they wont do anything about it though. What can we do?

It may be possible that your husband has a genetic disposition that allows for hernias to occur. Given our DNA make up, some of us can be predisposed to kidney stones, cancer, blood clots, whatever...There also exists the chance that the surgery wasn't performed properly for various reasons that may not be so easy to prove in court.

There are state emergency insurance plans that could help you with the cost of the surgery. In Calif, its called MSI, and in Arizona its called "Access" insurance, I forget the actual initials. But most states have these programs and you instantly qualify when you become a patient in the emergency room. You may not necessarily get admitted to the hospital. If you get diagnosed with a hernia, you'll get a referral to a surgeon who may take your case and perform it on an outpatient basis. Given that, you may qualify for state disability and get paid while you recover.

Personally I would call the first doctor and explain the situation. See if he is willing to work on your husband again. Unfortunately sometimes they don't always get the right thing done. I had a hernia repair this year too and had go back in recently cos they hadn't corrected it properly and got a cyst. You probably will still have to pay but maybe you can agree on payment plan with the hospital. Believe me hospitals are grateful for any kind of payment be it small, as they get enough people who don't pay at all.

My husband had a hernia operation too- in his r lower groin area- the md put in some kind of supportive mesh- will the 2nd doctor agree to testify in court that the other md treated him for the wrong kind of hernia-and that this isn't caused later by something else? it wasn't a hiatal hernia was it?? If so- surgery usually only works temporarily- he should wear good support-D

there are attorneys that give the first consultation for free, find one and ask what your chances are.....
frankly, I'd imagine they are rather slim, most doctors will not testify against other doctors.
