the reason they fired me was because of a background check. one of three they had run since ive been working there. the reason the bad check came back is because i have a felonly from ten years ago. they said the reason they fired me was because i did not put it down on my oringal application. when i asked the orginal manager that at the time hired me about the felonly at the time he hired me. he told me that if it happend over 7 years ago that i didnt have to put it down. I was not trying to hide anything. i told the manager that hired me up front before i was hired that i had this felony and he is willing to testify to this. is there anything i can do about this?

I'm not an attorney, but in my opinion, the hiring manager at the time was an agent of the employer. Therefore the employer knew or should have known about your record, and since they didn't do anything about it for three (3) years, they had accepted it and you.

Why now? What has changed? How were your performance reviews? Did you get regular raises? Any awards/ citations/ recognition for performance? Have you had any disagreements with the new boss? Is there a personality conflict?

I would recommend that you get a sworn statement from the hiring manager as to his knowledge of your felony and the advice he gave you, to wit, " ...over 7 years..don't put it down..". Then find a competent employment attorney (call the Local Bar Association for referrals) who will take the case on a "contingency basis".

If you have worked there for 3 years, and the felony was 10 years ago you, then when you were hired, you were within the 7 year requirement range. Duh, 10-3=7!! So you should have put it on your application, just to be safe. So, no I don't think there is anything you can do about it. Better safe than sorry,

Do you know where the corporate office is for the store you work for? If you could send a registered letter to them explaining the entire situation and your desire to remain with their company, I'm sure you would at least rate a face-to-face interview with someone that could help you out. after 3 years they decide to do a background check. if one was done at your hire date why another. think i would contact the lobor board, and most certain the unemployment office.make sure you have all you ts crossed and is dotted
