I hadn't eaten anything for breakfast today. I noticed my boss put his ham sandwich in the fridge, so I lurked by the fridge until he left. Then when my boss was out of sight, I tip-toed to the refrigerator, pulled it open, then opened his lunch bag. I unwrapped his sandwich and took half of it. As I was about 3/4 done with one half, he walked back into the lunch room, and I was basically caught red-handed eating his sandwich. I told him that I thought he brought it for me for being a stellar worker. He told me that today will be my last day for insubordination. I then made a V with my fingers, stuck my tongue in between them, bulged my eyes out, and flicked my tongue in and out with rapid oscillations; the motion of my tongue could have been modeled as a sinusoidal function with high amplitude and higher frequency. He then called security. My question is do I have a lawsuit for malpractice? What gives?

Get a clue as to how you're behaving....I own my own business, and if one of my employee's acted like that, I would honestly think that he was a CHILD. And no, you DON'T have ground for suing or anything like it. Sounds to me like you are lazy and want money handed to you without breaking a sweat or submitting to any type of authority figure. Hope you ARE a child, because any sane, competent adult wouldn't act that way.
One more thing: malpractice is a lawsuit that you file against a doctor or hospital for negligent medical care , moron.

You stole his sandwich without his permission. You basically made unwelcome guestures towards your boss, and those honestly were totally uncalled for.
He is not a doctor so there is no malpractice.
You also can't blame the boss for your hand guestures.
And this type of behavior is considered insubordination (failure to follow boss' instructions) as well as gross misconduct for stealing. So, I'm sorry, but as a human resource professional, based on the information provided, I would terminate you for gross misconduct.

That is why he is your boss, because he is a human, not an animal. At work people talk, communicate each other, no because you thought you are right. You assumed a situation but you have a boss, so you need to ask first...
Go ahead suit him, you will loose, becasue you did not ask before you took a desition... even with food...
When you are in a company's building you have to follow the guidelines before friendship... good luck...

You got fired because you stole his sandwich and made unprofessional faces at him. Every one gets treated at work with respect and that includes respect of ones property. If you treat someone with respect, you shouldn't be mooning faces . You should have waited for your boss to give you the sandwich. Happy job hunting.
