You haven't stated where you are from. But as an example, from Got-A-DUI:

"California DUI laws are such that every California DUI arrest gives rise to two different cases: a California DUI court case, and a California DUI DMV Hearing. If you’ve been arrested for DUI, or any type of California drunk driving offense, you must contact the California DMV within 10 days of your DUI arrest, or your license will be automatically suspended. Even if you are from another state, and don’t have a California driver’s license, you must contact the DMV driver safety office if you’ve been arrested for DUI in California, otherwise the California DUI suspension imposed by the DMV will be reported to your home state, and your license suspended there."

And from Texas Department of Public Safety:

"The Texas Legislature recently enhanced the program by amending the governing statutes to require that the arresting officer confiscate the offender's Texas driver license upon service of a Notice of Suspension and issue a 40-day temporary permit. In addition, the amendments provided for increased suspension periods, as well as a suspension for individuals who refuse to provide a specimen following an arrest for the offense of boating while intoxicated (BWI)."

So, you need to check out the laws for your state and how it is handled there. Good luck!

Well the answere varies from state to state. Many states have an instant suspension for 7- 10 days and then you may apply to get it back with the court until trial. Others have automatic suspension. Some states have none until court. I suggest you contact your local DMV or Court CLerk and ask.

In NC you have an automatic 30 day civil revocation. Then, you will have to wait to be tried or enter a plea. In the event you are convicted or you plead guilty, you will then lose it for a year. This is for a level 5 or first time offender.

fortunate you probably did not get them in AZ....4 DUIs in decrease than 5 years, you would be doing 12 years in penitentiary. it particularly is in AZ. I did 13 months in penitentiary for my 2d dui in 5 years.

If you break into the police station and steal your file, you might be able to avoid this unpleasent situation. Not that I would suggest trying something like that (wink, wink)
