I can speak from experience.. It is the company that you are suing that is responsible for all fees to the attorney. You are liable for nothing whether you win or lose! 3 yrs ago the fee was about $2,500. So it might be a little more today.

Fee agreements are negotiated between the attorney and client. Lemon laws also vary by state. Some attorneys might be willing to take the case on a contingent fee basis, others might charges hourly. Some attorneys will have the client pay and then reimburse the client if they get a settlement that covers the attorney's fees. Each case is different.

If your car is a lemon, you should look at the local/state laws. In some places it is illegal to sell a lemon (bad car).

I would then look at your contract you signed. That sometimes puts a stop to you attempting to return the car. If it is sold "as is" it makes it more difficult to return the car.

I would consider contacting consumer's rights groups, like the better Business Bureau.

If the law suit included payment of legal fees to be determined, and the plaintiff wins, the lemon guys have to pay the plaintiff's legal expenses.

If it goes to trial, the prevailing party can ask for attorney's fees from the losing party. That can go either way.

If it does not go to trial, you are responsible for your own attorney's fees.

You do but if you win you can ask for it in your damages, you may not get it, but it never hurts to ask.
