This relates to my earlier question. I flew to Ok. and went to court. Judge said go by with sheriff and do inventory, Everything was gone. I think he did Ebay auction, on Sept 30th. I can identify jewelery, commercial sewing machines-everything if I can just see pictures posted on-line, but I just don't know how to do it. thanks for any help in advance..............Kimmie

Give it up, Kimmie. It sounds like you owed a debt and didn't pay it, therefore your things were taken to cover some of the debt. Chances are that the sale of your things didn't pay the debt in full, and you still owe part of that debt.

You can't trace any activity on eBay unless you were the seller or the buyer. Besides, what would you do even if you did find out who the buyer was??

When you borrow money, you are expected to pay it back. That's how the real world works. If you haven't learned that lesson from this experience, you're in for rough times for the rest of your life.

A restraining order to keep him away from you? I don't thnik that has a thing to do with the property. The judge was just telling you to record the items you left with him so that if there were items left that were not part of the lien, you could retrieve them - or - so that after satisfactory settlement of the debt, you could prove what items of yours he was holding. You need to go back to court and have a judge rule in your favor that he did not have a right to dispose of your property under whatever agreement you made with him that gave him a lien on youe things in the first place. If you defaulted on your part of the bargain, I don't think you will have a leg to stand on, since you, in effect, by failing to repay him the loan (assume it was a loan, or however you defaulted on the bargain gave him the items you used as collateral under the agreement. I don't see where a restraining order does anything in this scenario except keep him away from you. Good luck.

If there is a restraining order it is equal to a stay. without vacating the stay they cannot auction or touch ur property. Go to the nearest police station and file a criminal complaint against them and lock them up. This is a serious issue and amount to contempt of court. Forget wheather u get back ur items or not atleast u can sue them and get damages. Go Consult a good lawyer. U could set things right.

I am sorry, but if he had a lien on your property then he has a right to get his money back one way or another. It is unethical to borrow money, or have someone to do work and not pay them. You would not want them to do that to you.
