They continue to call my husband & his sister saying that because their mother bought into it and it has their names listed on it as well that they are liable for paying the charges that she hasn't paid. Is this true?? My husband & his sister never signed anything so we don't know what to do about this!!!! His mother has a serious history of running up debt!!!

I just got a call from my sister in law & my husband and apparently they found out that their mother signed their names to the contract when she bought into it at the company so now that really adds to this mess!!!! All I can think if is total fraud now - not only with my mil signing her own kids names to the contract but also the person from Silverleaf who signed her up - they would have to have seen her sign their names to it wouldn't they???

No you are not liable for anything, they are just trying to con you into paying them because they want your money. Tell them to stop calling or your will report them for harassment.

Your mother is however liable.

Kate M is WRONG. She probably works for them or some other debt collector! If that were the case, I could put her on my account and have her held accountable! We all could! See how ridiculous that sounds?
If they did not sign anything, they can NOT be held accountable for it. They can claim they had no knowledge of their names being anywhere until these people started contacting them!! Get a consult with a lawyer and find out what rights your husband and sister have, as well as what rights these people contacting you have! I would tell these people, the next time they call, that if they continue to harass you...you will have no choice but to contact the police and report them for extortion and harassment. Then, when they do call again...do it!!!

I was checking back on my answers, and saw your update. Yes, in order for everything to be considered totally on the up and up, they most likely would have had to see id's with the people when they signed. However, they did not, so that is their problem! You guys seriously need to see a lawyer...and quick!! You have to get this cleared up! I feel so sorry for all of you, because this will probably put a terrible dent in your family relationships. Your mil will probably be in trouble once you see a lawyer and start proceedings to get this matter resolved. That's going to start the fights...if they haven't begun already! I know I would have deffinately opened my mouth to her by now!! I so wish you all the best of luck with this!! Please see a lawyer soon!!!!!

Listen to Callie - she knows what she's talking about. Also, you could have your husband and his sister send them a certified letter stating that they did not sign anything and they did not agree to assume any liability for their mother; also, if they are continued to be harrassed they "will be forced to take further action." This will put Silverleaf on notice.

Response to additional info: That is fraud! They should call the police on their mother. I think it's time to get an attorney!

Tell them that you have no intention of paying your MIL's debt and inform them that if they contact you again you will be notifying the attorney general in your state (it's free). It is illegal for them to contact you after you make it clear that you aren't paying the debt and to stop contacting you. Follow thru on your threat too. If your husband didn't sign anything - as in co-signed - you have no obligation to pay her debt.

Oops, sounds like you may need a lawyer now. Your MIL is a real piece of work.

Yeah I am afraid it is true anything that has their name on it is a legal binding matter and they need to pay it so that they can take their name off of it and be done with it. Good Luck.
