Xavier created a backup plan if any the mutants got out of hand called the Xavier Protocols. The Protocols gave detailed instructions on how to take out certain mutants in certain ways. Wolverine had to be decapitated by Cyclops' most powerful optic blast.

In X-Men 140 or so, Days of Future Past, I think, a sentinel blasted Wolverine, leaving only a skeleton. I believe it was safe to assume that he was very much dead.
Yeah, he CAN die, but won't really, as long as he's a viable character in the Marvel Universe...

Actually to respond to him being burnt down to his skeleton, that happened in one of his tie ins to the civil war series... and he was still alive.... Come to think of it, it may have been in a recent Wolverine Origins comic, not really sure.
