Their reasoning for not sending my paycheck is they had to hire a CPA to check the computers to make sure I hadn't done anything illegal. But isn't that a company problem? I didn't do anything to warrant that, and quit because I felt they were violating my privacy by going through my personal things when I wasn't there.

I live in the state of Virginia. Please help! Thanks...

No, they still owe you your pay. The fact is, even if you did something illegal they still owe you your pay. They could seek civil or criminal remedies for your wrongdoing, but they still have to pay you.

Are they gonna give it to you eventually or are you funding this witch hunt with the sweat of your brow? If you don't owe them money say for uniforms or say damage to private property, I can't imagine they have a leg to stand on. If indeed you did something that the CPA hypothetically found and it was illegal, they have the law on their side and could have you arrested, but I can't see how "holding" your check is doing them any good. I think they will owe you interest like a bank. If I was in your position, I'd contact EEOC and my state attornet general. They both know your rights better than WE ON YAHOO do. Good luck.

An employer can hold your final pay check if you have something that belongs to them (uniform, training manual, name badge) until you return it. If you don't have anything of theirs and they withhold your paycheck they are violating labor laws regardless where you live. In that case you can file a complaint with your state labor board and they will have to pay a fine as well as your pay.

That's violating labor laws. File a complaint with your state labour board.

They can hold your pay if you were still working for them and the case was not yet solved.

I read about you.
They have fired you, it's not important that you make the mistakes or company.
Because you have worked there for sometime and know that when you are leaving your job, they should paycheck to you because you spend the time for them.
they'll count the years and months that you work and will pay you the options (meant money)

local unemployment off will tell u how to contact wage n hour....they will talk to u for free.good luck.
