Texas Alcoholic Beverage Commission Code states that, "A person may purchase an alcoholic beverage for or give an alcoholic beverage to a minor if he is the minor's adult parent, guardian, or spouse, or an adult in whose custody the minor has been committed by a court, and he is visibly present when the minor possesses or consumes the alcoholic beverage." This means that we may not serve the minor, but we may serve you. Then you can legally serve the minor if you are his or her adult parent, guardian, or spouse, or other adult to whom the minor has been committed by a court.

I really hope it's not your spouse that is over 21 because you sound extremely young asking a question like that. If you can't figure that one out for yourself there is definitely something wrong with the school system in TX
If you are UNDER AGE then you are UNDER AGE period.. no matter who you are with....

legal age for drinking has nothing to do with your spouse..im not sure what the legal age is in texas but its usually 21, regardless if you are married to someone old enough to drink

No. it depends on how old you are, not your spouse, your brother, or anyone else.
It's the same as asking whether you are allowed to drink in bars if your best friend is legal age but you are not.
