Check with a lawyer to be absolutely sure for the law in your state, but usually to be legally separated you do need to file in court.

It depends what country you are in. Different countries have different laws. Generally, if you are separated from your spouse then it doesn't have a legal significance. For instance, if one of you dies, then the other inherits.
While you are separated, you are free to behave like a single person, except that you can't marry.

You'll have to check the laws in your state ... but usually it works like this: separation for a year (living in different houses, basically) and then you can file for divorce. You don't have to do any legal papers just for separation (I don't think). But definitely check with your state.

The only way a seperation CAN be legal is if seperation papers are filed. A seperation is filed when a couple is having problems in their marriage and may or may not reconcile. If after a few months they can not come to terms and do not wish to reconcile divorce papers are filed.

It depends on what state you are in. Here in California you have to file to become legally seperated, which means that basically all your money and finances become seperated, but you are still married. I am seperated from my husband getting ready to go through a divorce myself.
