Yes. Congress just passed a bill (signed by Bush) that stated it was up to the president to decide what kinds of interrogation techniques were acceptable and which weren't. They gave him legal authority to torture -- which he was already doing *illegally*, they just gave him a legal basis for it.

American laws do not apply to foreign soil and the CIA is above the law. Therefore, it is neither legal or illegal. Just immoral.

Torture is not legal wherever committed because it is not allowed under the generally accepted principles of international law.

it is only illegal if:

a) it is illegal in the country it is committed (and thus would be tried and investigated by the police force there)
or
b) it is done to american citizens (the Constitution protects citizens from 'cruel and unusual punishment' of which torture is certainly one.)
