are wondering if we find that she did not have a will, will her assets be divided between her only sister living and two nephews that are still living> Also what site do I go to to find out any legal records in Center, Texas (thats in east, texas. My husband's mom said she told her she had a will and she was the executor but how do we go about starting the search...would we go to the couthouse first? then have to call all banks we know of around there and see if she might have had a bank deposit box rented with stuff in it. Do we get a lawyer and he will do all this? I really would like to know the site you can go to for unclaimed money! THanks

If their is no executor...the courts will appoint one. Then all the assets will be used to pay off debtors first. What ever is left is usually divided among the immidiate family.
It's best to talk with a probate lawyer.

to the person who just called the questioner a greedy pig...don't you dare judge anyone. its a legitimate question...if you had a loved one die its hard enough to deal with the death but this a part of the process. my grandfather just passed away and it was very hard to deal with the estate holdings...but it has to be done. so until you stand in someone else's shoes don't go throwing names around. you might stand behind the cover of the internet to hide who you are but don't let that affect who you should be!

to the question...

i would try and find out who your husbands aunt lawyer was. my grandfather left us a note in a file on his computer telling us where all the important papers were.

if you find nothing like this and i was in your shoes i would consulte a lawyer and see if i could get some help finding out. if she said there was a will then it should be around.

there is no way to say how her assets will be divided as that was up to her and should be in her will. if there is no will than i believe there is legal action your mother-in-law and husband can take to make sure her assets are passed on.

Not sure in the USA but I think without a will it would go to her sister.

It's too bad people don't make their wishes known before they depart this world. Unless she doesn't have much of course. My husband's aunt died without even enough money to pay for her burial. In fact no one even knew she was in an auto accident until after she died. I don't understand people who live like that (and die like that) but hey, plenty do. I don't even know if they ever had a service for her either. I thought it was awful to just go without seemingly not even having anyone close enough to notice you missing for that long! Not like she didn't have relatives either. Everyone had to scrounge through her place to see if she had a will or anything. She didn't have nothing...not even a penny to her name. My husband's mother paid for her cremation and they didn't even have a service or mass...it was just creepy and cold and meaningless to me to leave the world that way. I assume my husband's brothers and families scraped whatever was there clean. Hubby brought home a couple of dressers...she hardly had anything anyway.

Unless someone leaves me something specifically in their will, I really couldn't care less to go after whatever someone has. There will be enough vultures there I'm sure.

look around her house for a will, or in the address book and see if she has a lawyer listed ...if so, contact the lawyer and ask them about a will or other information they might have on her. i am sure if you look and check her checkbooks to identify her bank. i would have the lawyer handle this research.
