I was watching a show and the above topic, there were serval instances when explores ate there feloow humans for survival. None of these men were brought up on murder charges. There is one instance were 6 men got trapped in the mountains throught the winter and only one walked out, he ate is traveling compainos to survive, he was foung guilty of murder. So where is the line between depeate act of servival and murder

How can cannibalism be murder if the person being eaten is already dead. Has anyone ever heared of the Donner Party? Some of the people froze to death, the living ate the dead to survive. The only way I can see it being murder is if one person actaully KILLED another to eat him, it also should be proven beyond a reasonable doubt in a court of law.

I think that it is a thin line, but if the person is already dead, it's definitely a desperate act of survival. If a person told them to kill them and eat them to live, I'd say survival as well. However, if the vicitm was killed, against his will and for the sole purpose of becoming food, THEN it's murder.

It would be murder if he killed the others. It would be survival if he ate them after they had died.

However, it would not be murder if the one was near death and asked to be killed so that the others could live.

But I don't make the laws.

I think it should always be murder eventhough you are starving. I know this sounds harsh but you could never know the circumstances of the dead man death. The survivor gets to live eventhough he has committed a crime.
