A house was built next to us. The construction workers damaged our driveway.

They were illegally using our driveway as a short cut to the construction site. They left scrapes, gouges and stains on the concrete. We called the construction firm and told them not to do it again. But the problem continued. We wrote them a letter and sent photos of the damage (see pictures below). The construction firm called and left a message on our answering machine. We recorded the message on the PC. The woman of the construction firm told, that the concrete will be cleaned and repaired.

We saw Mexican people who cleaned the driveway. We saw that blue / gray stuff (see pictures below) after the cleaning. We thought it was normal and it will go away. But it was not normal. The cleaning people used too much pressure and damaged our property.

I called the woman and told about this problem. I asked who did the cleaning. She was extremely nasty and impolite. She told that nothing was damaged and that I am lying. I just wanted to know who did the cleaning so I can ask them. I told her that the concrete does not look normal. I said it is not her fault and I have to speak with the cleaning company. She was aggressive and told she is not in her office and doesn't have the contact information now. So I asked her about the company name. She said Jim Duffy. There was no cleaning company named Jim Duffy. How she acted was not normal. Normal companies have a liability insurance and want to solve this problem.

I think that the company doesn't have a license, because they couldn't use the cleaning machine correctly. The construction firm got nervous and aggressive when I asked about the company. It could be possible, that all workers of this construction firm are illegal immigrants. I saw them working on weekends.

We can prove with the pictures that they damaged our property. We have the telephone recording that workers should come to clean and repair the driveway. We have photos of the cleaning damage.

What is the best way to handle this problem?

It sounds like you are going to have to go to sue them.If the company was nasty with you and called you a lair, then they have already made up there minds not to help you. And if suing the company dose not work you may be able to sue the home owner them self.Just make sure you keep all your pics and phone messages and don't forget to take them with you to Court, judges likes to see those things. Good luck with you battle.

I don't know what state that you are in but I would check Small claims court or a justice of the peace court(less than ($5000) Dollars. In Texas if you go to a justice of the peace court you Dont have to have a lawyer

Did you take phone of their trucks, the work site or anything to prove how the property looked?
