Was it a legal marriage or commonlaw a legal marriage needs
to go through the legal process of separation and divorce papers
and terms of separation. even in commonlaw there has to be a separation agreement between the two people and a division of mutual property

It is considered abandonment after 5 years of no contact/ liveing apart. You still might want to check with the affirars dept. at the court house. Im pretty sure you can do that online, go to your city's website.

You can use that for grounds for divorce, but it still has to be documented with the court. You cannot remarry, and it be legal if you don't sign on the dotted line.

I don't think so, you are still legally married. Depending on where you live you can file the papers yourself, or you may need to contact a lawyer to file them for you.

if you have a marriage license...then you will need to have the proper papers to terminate the marriage. There is no easy way out of a marriage unless the spouse dies....and in no way am I suggesting anything of the sort! ;o)
