The court consists of nine Justices: Chief Justice of the United States and eight Associate Justices of the Supreme Court of the United States. The Justices are nominated by the President and confirmed with the "advice and consent" of the Senate. The nine justices of the US Supreme Court have been in flux this year, with the resignation of Justice Sandra Day O'Connor and the death of Chief Justice William H. Rehnquist. Rehnquist's own nomination was confirmed by the Senate on this date in 1986. President Bush nominated DC Circuit Judge John Roberts to fill Rehnquist's seat; Roberts is facing Senate confirmation hearings this week. Two justices born on this date were Chief Justice Warren E. Burger (1907-1995) and Associate Justice David Souter (1939).

There are nine members of the Supreme Court. The new Chief Justice is Roberts. Alioto is also new. Justice Scalia is the leading conservative Justice. Justice Kennedy is the new swing vote justice (in the middle) taking the place of O'Connor.

Many people think the swing vote is Kennedy... another main influence is Scalia.
