Im thinking of pics taken of operations taken whilst patients asleep? These end up in medical journals and the net.... do they need the patients permission to take and publish pics of their body parts?

I recently had surgery for breast cancer and the surgeon asked if I would agree to have before and after surgery photos taken. When the time came the medical photographer arranged a special screen so that only my chest was in view, but I did also sign a form agreeing to the photography and giving publication rights, if necessary.

yes people are asked for their permission if the photos are to published or taken however this is written into the consent form / procedures in a lot of hospitals as they have video cameras in the operating theatres. although most of this is done in a teaching hospital. your permission is also asked if a student is to be involved in your case at anypoint aswell.

To publish - Only if the pics are recognizable as a specific person (generally if their face is showing). It is necessary to get permission to take the pictures to begin with.
