There was a time in Texas that was true. Now, if another man is in someone's house to do harm to anyone there or to steal, he can lawfully be killed or wounded.

It is a terrible thing to kill another person.
You would regret it.
Get some pictures so you have proof, then;
Use a broom or something not considered a deadly weapon and put bumps on the guy. After he is gone use it on the wife's backside.
If she says she is sorry and wants to be forgiven, be a man and forgive her.
Women stray for a variety of reasons.
Maybe you have been gone too much or you sit in a chair and ignore her too much.
Maybe she is just a horny little wench who will never be faithful.
If so, give her a couple of weeks to pack up and move out.
Remember, you've got the pictures to use against her in divorce court, on the internet, anywhere you want to post those pics.

No. Here are the questions to ask (and that the authorities will ask and investigate:
Was he an intruder and did he forcibly break into your domicile?
(No. He was invited in by the wife and was having consensual sex.)
Was the other man a threat or pose a threat to the husband's life?
(Probably not. Not enough information available.)
Now he could kill the adulterer. He would go to prison, just not for so many years as it would be a crime of passion and not premeditated murder.
Best bet: Dump the wife.

Generally speaking, of course: Can he? Yes. Is it a crime? Yes. Is it murder or manslaughter? Could be either, but if they offer manslaughter, he may want to take it.
