If the checks is made out using "and" it must be endorsed by both parties. What is more, some banks will require you both to be present when it is deposited or cashed.

If it is made out using "or" it can be endorsed by one of the people listed.

e.g. "Mr AND Mrs Smith" must be endorsed by both people, "Mr or Mrs Smith" can be cashed by either person alone

If it is Mr. AND Mrs. both have to sign, if it is Mr. OR Mrs. only one has to sign before depositing or cashing.

Check with your bank, but in mycase I was told that both of us need to endorse it. (My husband and I)
