This will be determined by the workforce commission in your state.
In the state of Texas the employer is required to pay all wages due regardless of the circumstances of dismissal. In order to withhold any portion of your wages you must have signed a form stating that they may do so. If the employer wishes to receive goods or money stolen back from you they must get the police to press charges and sue you for damages and court costs.
Most likely the police wouldn't bother with such a case.

I believe that your employer can hold you accountable for the gas "drive off" or rather the gas you gifted to this person. I would just count your blessings your employer didn't turn this over to the police because theft from an employer is a felony.

The correct procedure would be to pay you for all your wages and then file charges with the police for the theft.
Call them and tell them that you want all your money now and that you want to be prosecuted for the theft.
Seriously, how stupid are you? Let them deduct the gas from your last check and be thankful you won't have a record.

If that is all they do, then count yourself as fortunate. They are being kind. I would do my best to avoid using them for a job reference. A future employer will call them sometime in your future anyway, so be very gracious, thank them for their tolerance, and send them a Christmas card. They can still make your life miserable. Make nice with them.

They should pay any wages due but prosecute you for theft. Perhaps it is best to let it rest because defending yourself in a criminal matter will cost far more than any wages that may be due.

If your boss wants to be a jerk he could press criminal charges against you. I think they can withhold the money from your check - not sure. Good luck finding another job!
