Is it illegal to record your personal telephone conversations?

If they call you?

If you call them?

How about if you make them fill out a form stating it is OK and then sign and fax it to you before the call? WIll this need to be done each time or just once for each contact?

You can record asking them if they'd mind being recorded and get their consent on tape. This would need to be done at each call. BTW, if you leave a message on someone's answering maching, you care giving your consent to allow the recording. And finally, courts are lax about punishing someone who commits the crime of recording someone without their consent.

1 you must let the person know you are Recording the phone call if you dont they can have you for it and asking someone to fill out a form stating it is OK and then sign and fax it to you before the call? , your not goin to get many call you thay will think your cracked in the head , if your that worried about someone calling you best thing to do is have the phone cut off then none can call you

If you are willing to let the person know they are being recorded, do what businesses do - have a message at the start of the call saying 'your call may be recorded for training purposes' or something along those lines but something relating to home use.

I dont know if its like this EVERYWHERE. but i know its illegal to record a conversation without the others consent. meaning u have to tell them that the call is being recorded and they agree to that . thats why when u call the bank or something, they will say this call is being recorded for security purposes, and if u arent comfortable with that then u can hang up.

In most countries YES it IS ILLEGAL to record any form of conversation without EVERYONEs consent.

You may be prosecuted if you are caught illegally recording a conversation however it is usually a private prosecution. Most law authorities are too busy to deal with it themselves.

It's illegal if the other person doesn't know the call is being recorded. Telling the person is sufficient. There are exceptions, but in general the above is true.

I would think it would depend on the context of the phone call and what used you intended to make of it.

When you call a company, bank or call centre, they will always advise that your call may be recorded 'for training purposes'.

I would suggest you follow the same rules if you intend to moniter your calls. You may have to consult the data protection act to establish exactly what you can and cannot do.

Depends on the state you live in.In Texas as long as 1 party is aware of the recording it is legal

You have to let them know they are being recorded and you need verbal or written permission to do so. Easiest thing is to start the recording, tell them they are being recorded and ask for verbal permission and get it on tape. If they say no, you have to stop recording.

Get it each time. You always have to have permission to record voices.
