im 15 years old. i was with two of my friends in the woods. one of my friends has ADHD. the one with ADHD and me started talking **** to each other. he threw a stick at me i threw one back. he started to go crazy and throw rocks at me. i had a stick in my hand and when he approached me, he grapped the stick. when i got the stick away from him, i hit him in the head really hard. and then i ran. is this a crime?

It sort of depends. People will hear his side of the story also. If you had reason to think you might have hurt him badly, then I hope you ran to get him medical assistance.

Probably this will be largely overlooked by law enforcement, unless he required hospitalization or has some sort of permanent injury. Explain to your parents what happened and be honest. They can help you more if they know the whole truth. They will be on your side since they likely be financially responsible for your actions if the law determines you did something wrong. Based on the information you have given, I rather doubt that much comes out of it, though.

So, talk with your parents, don't sweat it too much, and stay away from people who you feel you might fight with for any reason.

First, ADHD is not important in this instance. A person or child with ADHD is unable to pay attention like others in class or to conversations due to being distracted but is not in any sense of the word crazy or unable to conduct themselves in society. A person not having ADHD would likely have acted in the same way to the situation.

Second, hitting another person with anything, even your fist, is considered assault. Battery is proven when the instrument used to hit is considered deadly and able to kill. If it was a twig then I'm sure it wouldn't have been considered battery. But, if the stick was large and sturdy like say a baseball bat then yes that would be considered a deadly weapon and battery could be proven.

Finally, hitting another person, for any reason, with anything considered deadly is considered a crime. The penalty for this crime will be decided according to previous record, age, and circumstances. I do not believe a prosecutor would consider an argument or throwing rocks to be sufficient to determine self-defense as you could simply have run away.

This is serious and you should discuss this with your parents. Sometimes if you have no prior problems and it can be shown that you did not understand that what you were doing was considered a crime then they may be easier on you. Also, the seriousness of this escalates if the boy hit had to have any kind of medical attention.

Your age is an advantage. You would only do time in juvenile detention (unless the court decided to certify you as an adult, which is very possible, especially if you had killed your friend with the stick. In that case you could get 25 years to life).

Lots of young peopole are doing some serious crimes, thinking that they can get away with it as a juvenile. Don't ever bank on that.

I think it is a shame when a few kids can't get along without a physical confrontation. But since you did have one ..just from what you have said my guess would be if they decide to press charges ...and he has any marks to back up his claim ..it will be up to the judge after he hears both sides and that of the third friend also. personaly I would chalk it up to kids roughhousing and let it go providing all concerned has a clean record.

You need to speak to your parents about this: but it sounds like you were defending yourself, if your telling the story like it happened. You were both assaulting each other at one point, talk to a parent or relative. ADHD is no excuse either.
