i got married 5 years ago in germany and want to get divorced.my wife run off to her home country brasil and i cannot find her. i myself live as german in the uk and haven`t got time or money to go everytime to germany to sort the divorce out. can i not get divorced here in the uk and all without the presents of my wife?

i am sure you need the signiture of your wife and i think it needs to be done in germany...

not 100% sure.

You can be divorced in the UK if you have lived here a year at least. You can get the divorce without your wife's agreement or knowledge but you will have to be able to show the court that you have made every effort to find her and have her served with the papers. The grounds you could rely on would be separation for 5 years or more, or possibly desertion for two years - best if you consult a lawyer as your divorce does not sound straightforward. If in doubt contact Resolution, which used to be called the Solicitors Family Law Association.

I got married in Europe, not Germany though, but got divorced here in the UK. You need an address for the papers to be sent to but not the presence of the other party.

I would'nt have thought so,you will have to have all the relevant documentation and of course she will have to sign certain papers to accept the papers.If you dont know where she is,I think maybe like here you could get divorced on the grounds of desertion.

cI would check with a solicitor, but I don't think you an be considered divorced here without her signature until a certain amount of time has elapsed. You could however become legally separated in the mean time.

silly question really, but how did you manage to get married in germany without your wife being present?..wish l had thought of that!!!!!!!!!
