either they catch a cab or other public transportation like a train or bus. maybe they call their other half, friends and family member to pick them up. some bars already know what to do if you are a regular client, they probably take them home themselves.
some have that free designated driver that assist drunk people, they just call the hot line and they come in a scooter, they get the key, drive them home and they can leave ensuring you are safe with your car and being. it was feature in one of those talk shows....

People drink and drive all the time. That is why they have organizations like MADD (Mothers Against Drunk Driving). Some of us are smart enough to have designated drivers and some bars have a 'ride home' program where they will give you a ride home from the bar to keep you from killing yourself or someone else. If bars are facilitating a potential felony, then so are liquor stores and any store that sells beer. We either have to take responsibility for our actions or make the sell of alcohol completely illegal, which will never happen because the government still remembers what chaos it caused the last time they tried that stunt.

States have a blood alcohol level they deem acceptable for driving home. So light alcoholic drinking can be acceptable and still be able to get home.
There are also 'designated driver' programs where in you group of friends pick some one to not drink who will be the driver for every one else.
Finally if someone is looking really intoxicated another may recommend a cab home, or some states have cabs specifically for picking intoxicated people up and taking them home for less than what the usual cab fares are.

It is obviously leading to a felony, but what can you do? Force people to call a cab or have a designated driver? It just can't work: people are too lazy and too drunk. You might as well bring back Prohibition, which we obviously can't do!

If you have had too much to drink, you should take public transportation or get a cab or something. No one at the bar is telling you to drink to excess, though I don't think anyone should drive if they have been drinking. It just isn't worth taking the chance of hurting someone. That car that you crash into could just be someone that you love, and who could live with themselves if that happened?

When you have a DD or I should say a Designated Driver. That driver usually has one beer, or doesn't drink at all. If they do we usually call a cab. Its not worth the fines, or worst of all its not worth someones life.
