ok, i got married in 1993. my husband and his new girlfriend brought me divorce papers for me to sign. all of the dates and stuff were wrong, so i marked on the papers and put the correct info. on there then gave them to him to bring them back to me fixed. well, in the mean time we went to court for assault with a deadly weapon, on his part, and he never paid his divorce atty. so like 2 years later i called the courts, and it said that the divorce was denied by prosecution. well, he moved to florida and i talked to one of my "so called" friends and she said that my husband got a divorce in fla. but i call the courts in texas, and it still says denied by prosecution. so are we divorced or not? how can he get a divorce from me in another state, and it not be posted nationally. so how do i find out all of the details with out pending a bunch of money on an atty.? plz help, thanks

You can get married in one state and get a divorce in another state. Marriages and divorces are not posted nationally. If your husband filed for divorce in Florida an attempt should have been made to serve you notice, if your were not served notice then it should have been in the papaer 30 days where you live to give you a chance to respond. If no one hears from you within that time frame then the divorce is granted. You may have to spend money to see a lawyer. Your husband may have been granted a no fault divorce. Had you known about it, you might could have requested and been entitled to a settlement for what you contributed to the marriage. The Texas courts will not have records of Florida divorces. The records stays within it's own states. Perhaps you can speak to a domestic attorney at legal aid in your area to get better advice. Their rates are cheaper than going to a private attorney. You're doing right to get this sorted out now. The longer you wait, the more it's going to tangle.

If you look on the papers, you will see a courthouse name and a file number. All you need do is contact the court, itself -- a phone call will do, and ask the clerk if the divorce has been finalized. They should be able to tell you. You can also request copies of the finalization. It's usually a few dollars to do so. You may need personal identification information, so that they know you're you, and no one else. You can also see the courts, online, if the phone number isn't listed on the documents.

I am not sure if the website above will help a search but it is for Fl courts... it should at very least point you in the right direction to found out what info you need.
You need a divorce decree to be divorced.. if you do have have one you are still married.... and if he did file in another state you should have been notified. ... good luck

He couldn't have filed for divorce in Florida if you were married in Texas. The divorce could not have been finalized without you having been served papers. You're not divorced. That's the way it works in Delaware anyway.

You have answered your own question. You called the courts and it says that the divorce was denied by prosecution. Therefore, you are still married.

you would have to check in the state where he got the divorce ... if he is in FL, then TX has no say in it.. check with the county records clerk in the county in FL where he filed to see if a final decree was awarded ... divorces are not posted nationally, as long as the FL divorce was granted AFTER the TX divorce was denied, you are legally divorced ..copies are available from the county clerk for a nominal fee. call to see if it exists. you will need a copy before you can remarry.

Neither marriages nor divorces are posted nationally. You have to talk to the courts in that state.

Some atty. will answer your quistions abut the laws and you might have to find out where he lives in Florida and call there courts and see how he did it.

You are still legally married. File the divorce yourself on grounds of abandonment. Good luck.

he cannot get divorced in another state. only in the one you were married in and you would have to have signed new papers.
