I hate this realtor, she has reduced the price of my house WITHOUT consulting me. I spent 25k on a custom brick driveway, she said "The neighbors don't like it" Why would she talk to them anyway? She has insulted my decor, Told me she will not answer emails if I send her too many. (3 is too many for her) .Which I rely on as I am in Houston, TX. She was supposed to list the house 48 hours after we signed the contract, it has been Since Sept 5, 2006. What is a LEGAL way to terminate her contract?
She's horrible. I bought new fixtures for the house before I left. She removed them and bought new ones with a fund I left for "just in case repairs" she was not autorised to make the purchases.
I want her gone, Please, does anyone have suggestions on the LEGAL way to terminate my contract with her?

Her broker does not have a direct number. I called her, and she called the realtor and the Realtor sent me an email saying that when I fly out to Ca. She AND her Broker would meet me at the house...
I can't get a hold of the Broker.

Immediately notify the realtor, the realtors broker, the ethics board of the board of realtors, and your state real estate licensing board of her actions. Use certified, receipt requested mail.. Further, you may want to just turn this over to a real estate attorney and have him/her handle this alleged unethical behavior.

Immediately send the broker and the agent a certified letter outlining the reasons you are terminating the contract. Also include in this letter a statement that you intend to report their action to the local Real Estate board.

You should tell them to stop going to the property and designate a person they should give the keys to.

If this is not sufficient, you should hire an attorney to write a letter for you outlining the fact that you have sent them a certified letter and the next action you will take will be through the courts.

As far as I can tell your realtor is in violation of the realtors agreement, and since she is technically "employed" by you, you should be able to just fire her. I would check with the local Board of Realtors and make sure, and i would also file a complaint against her and the realty company she is working for with the board. She cannot legally lower the price of your home without your consent and a bunch of legal paperwork. And if she is any kind of realtor she should be doing anything in her power to keep you happy, and by saying she won't reply to your emails should also be grounds for the termination of the contract.

I can't address the practices in California for complaints, but here is the general idea:

File a complaint with: Her broker, the state agency responsible for regulating real estate agents, and the local MLS board.

Tell her and the broker that you are going to file these complaints (AND DO SO). There are SO many things she did wrong.

Once again, I can't address California issues, but in Texas, making these complaints should get the brokers attention.
