I am in the UK and have gone to court three times regarding my four children. 9 years ago, my eldest son was 'allowed' to choose where he wanted to be at the age of 11. Most recently (6 months ago) my two youngest daughters who are 11 and 13 were made to sweat on this by the judge. The eldest was "probably" old enough, but not the 11 year old.
I have to say, my son who chose to live with his father 9 years ago, is the first to admit that he wasn't old enough and felt pressured into it, and feels that it was the biggest mistake of his life.
Cafcass interview the children and assess how they feel about the split. However, they are not always as proffessional as they seem.
In short my friend, it is from 11 years old if you are lucky. However, bear in mind what you were like at that age, and bear in mind what your child may be going through in making a decision.
Best of luck with your court case. :-)

Probably the answers here are about right. Exception would be if you take him to psychiatrist and they determine living with you would be better. Then the court might listen.
