i have a 2 year old son who's bio father has never seen him. friday i got a letter from him & his wife stating that he wanted to reliquish his rights...does that mean he doesnt have to pay child support?...he isnt on the bc & my son doesnt have his last name...what should i do?...can i deny him his request?

Check on line. Most states have a department of child support enforcement. There's loads of info there, FAQ's, etc. Always a lot about laws regarding collection and rights, etc.

By relinquishing his rights, he is not absolved from paying support. If he denies he is the father, paternity may have to be proved. I looked and this subject is covered on the website.

You should get a lawyer to answer this question. However, I hope that whatever the answer may be to the question that everyone, including the father will keep the child's welfare uppermost in their minds before making this official. Too many things may happen in the future if this 'father' does not participate in the child's development. Now, if he is a rotten individual maybe it would be best if he did give up all rights and never see the child. I hope you will find a father figure if that happens. If he is just trying to duck out on child support I hope you don't allow him to do this. Please think this through from all angles and get some local professional help before doing anything.

if he wants rights to him you can't deny it. the only way you could is if paternity had already been established. you need to talk to a caseworker at DSS or a good lawyer. what you can do is make a case concerning the fact that he hasn't ever had anything to do with the child. If they do allow him to see your son then he has to pay child support. However he can be penalized on his visitation rights. they may make him have supervised visitation where you or someone else that you approve of to be with him while he is with your son. there are a lot of loop holes that you can go through to better suit you. talk to a lawyer before you do anything. where in SC are you. i may be able to recommend a good attorney for you. i'm going through this myself. These are good questions and you need to talk to a lawyer. My feeling is that even if he relinquishes parental rights, he may still be responsible for child support.
