The line damaged a wall where power was being supplied to and the owner thinks its my responsibility to repair her wall since the lorry is mine. who is to repair the wall? How far are power lines supposed to be above the ground? The case is heading to court, can i win? I offered to repair the wall but she refused and started demanding too much cash as a way of settling the issue outside court. How will i defend myself in court?

If you sue them...be prepared for a counter case against you for negligent driving and wilful damage of property.

Ultimately, I think you are responsible for the damage to the wall since you caused the power line to fall. If you have already made the owner an offer to repair the wall, that will be taken as an admission that you accept the accident is down to you. It is up to the court to decide the level of costs, not you or the owner.

I dont know the legal requirement for the height of a power cable, but it might be well worth finding out if this has ever happened at this site before...if the cable is so low, then surely you are not the first truck to hit it!

If you haven't retained a competent solicitor by now you should do so immediately.

Assuming that there is a standard for minumum height for the power lines -- and I'd be surprised if there isn't -- your claim against the power comany would be for any damage to your vehicle. I would think that the property owner would have a similar claim as well.

If it damaged your vehicle, I would say yes.......If your thinking about punitive damages....I would say no........just make sure your truck wasn't higher than the legal limit or you're the one who'll be chased for damages......
