IN CALIFORNIA: If both paties have come to an agreement in regards to EVERY aspect in the marriage (property, child custody, visitation, child support and spousal support), then you would need to go through the dissolution process as required by the courts. In order to do that, you must know, for sure, that you have completed the dissolution documents correctly by knowing the difference between legal and physical custody, you must know what it means when they refer to the word "property" because it not only refers to a residence or land, but other kinds of property and includes debts as well. An attorney is able to type up something called a Marital Settlement Agreement or a Stipulated Judgment per your mutual agreement and it would be faster and more effective that way than if you would go through the whole, entire dissolution process. In most cases, parties start out with a mutual agreement, but once the agreement is ready to be signed by both parties, one or the other almost always ends up unhappy with what the agreement is or changes his/her mind and doesn't get signed. That is where the situations really calls for legal guidance. Also, an attorney is able to calculate and give you a rough number as to what actual child and spousal support should really be by running a special calculation through something called a Dissomaster which is the same special calculation program that the courts use to determine support. It is not as easy as you think. The agreement that you guys sign, must be in proper, legal form that legal offices prepare and must be signed by the judge for it to become an order of the court. I would not go without an attorney, especially if it's a mutual agreement. Good Luck.

If you can both agree on everything = you can do a do it yourself divorce= and have all your paper work inline-it is much cheaper= do you know anyone that has done that?? You could use theirs as a guide and put your info into it and pay the court filing fee- how about legal aid? It is legal in NM- I don;t know about the state you are in. D

You don't. But it is so much more fun to make your spouse pay in blood, stress and money. That is why you get the bloodsuckers to front for you.
Get a lawyer involved and it won't matter what either of you want, the lawyer will make it confrontational, and he will give you plenty of plausible reasons for doing it.

It depends on the state you live in, I live in California. And here you can go to the court house and get the papers to do it yourself. As long as you both agree. You can Also go to Reno or Las Vegas NV. File the papers yourself.
