He was a little slow but so personalble that customers lined up and kept him after he was suppose to be off work. Overtime is not allowed so he came in late to cut back, obviously couldn't leave early because there were always customers wanting Him.
A black lady requested his help by interupting a customer he was waitng on. He said sure, when I am done with him. She interupted the boy and got the same reply. He finished with the verbal part and picked up the phone to finalize the order, she was stomping off and he hollered, Maam, did you want help?. She replied, I am filing a racial discrimination complaint. She did, he told them what happened. Two months later, after getting his fifth award for top sales, he was taken in the back and fired for 'not filling out his overtime reduction papers properly'. No warnings, no help with how to do it, and three days b 4 his first Christmas to be able to buy gifts for family. He had worked their 4 1yr and they never complained of a thing

That's a pretty sad story, I must say. Sad enough to cause my reconsideration where I buy materials. And of course he can sue. You can sue over anything anymore but I believe his cause would be slightly more honorable than the average lawsuit. And if he does and doesn't win, I'm sure there's a Lowe's that would gladly take in his business- if they haven't already.

I'm not sure how this is reverse discrimination. You're talking about two different issues -- 1. Not being able to work overtime. 2. An incident with a customer. I'm not sure how the two affect each other. He could possibly explore the former issue because it sounds like something management should have warned him about. But working overtime when you're not allowed is a major problem... a lot of liability. If this sales person is as decorated as you say he is, you would think he would have a good relationship with management and they would have spoke to him about his failure to file paperwork.

Check into, but the discrimination (reverse, or not) seems like a stretch.

Since "false advertising" falls under the Lanham Act, only a direct competitor (not a customer) can sue them under the theory that false ads are "unfair competition". I've seen your hoes. You are no competition for Home Depot, no matter what they are selling as a substitute.

IF this is true as you tell it, he should have already talked to an attorney. I would think Wal-Mart is in deep trouble. They don't need any more bad publicity. WHY didn't the guy do something when this happened to him?? This was last December? If he waits any longer time will be against him.

The LADY should have her asss kicked to shoulder height, which would make her very top heavy and she would fall on her big mouth.

I think he should sue for wrongful termination. Tell him to get a lawyer.

I am really not sure these big companies can pretty much do what they want and get by with it
unless he feels he can really win i would just move on

Well if he worked in an at "will state" he has no grounds for legal action.
