She had him put in jail, and hes in so far for two months, so now when can she start getting child support from him? How will the court make him pay now that hes in jail?? what now??

PS..HE OWNS NOTHING- HE HAS NO ASSETS AND NO ONE IN HIS FAMILY NOR FRIENDS IS GIVING THESE TWO **ANYTHING** NOT ONE PENNY!!

I wouldn't set my hopes on him having a sudden epiphany and immediately start paying her when he gets out. He obviously has no intention of doing so, no matter the consequences. She needs to learn to not rely on him and instead depend upon herself for the financial end of things. The court can only draw up an order on what he is supposed to be paying, and if he gets a job will garnish his wages if he gets a regular job. Many men are very stubborn and will go so far as to not work and make their own lifestyles suffer in order not to pay.She will get his income tax refunds if he ever files them and she is not on assistance. If she is, the state will get the money from his tax refund.
It really is not a good idea to have him arrested for it. It defeats the purpose. He can't make a living in jail, or without his license, in most instances. Suspending deadbeat dad's licenses is the most ludicrous form of punishment for nonpayment of support that has ever been devised. They can't work if they can't get there. And there are many jobs that one has to have a license for.

well hope fully a judge has issued a order of support for your sister with a set amount that he is obligated to pay weekly. This payment will will start on the day the order goes into effect ,unfortunately since he is in jail your sister will not get any thing from him til he is released . But he is obligated to pay the arrears for the time he spent in jail. It will more than likely take 2 to 3 weeks after he gets out before your sister will see any payment of any type ,in the mean time hopefully she can get assistance at your local or county welfare office ,good luck and i hope this guy mans up and takes care of what is his

Well, being in jail, he's not making money, so she's going to have to wait now until he's out and get's back to work.
If he has a job he can return to right away, the state can put a wage withholding order on his pay and tax returns. I've had to wait until tax returns were filed before, so that ment my kids needing help in a years time!

Don't let her step back and not pursue any of this. IT's the KID S that are owed.

The court can -- and very often does -- compel the sale of some of her ex's assets (boat, car, truck, etc). At an enforcement hearing -- which should be coming up soon -- the attornies and the judge will determine what actions will be taken. It's possible that someone is waiting in the wing (mother, father, sister, brother, girlfriend) to hand over the amount owed in cash in order to spring him from his cell. Otherwise, he'll need to start signing over assets.

I have been going through this for 4 years....the judge will issue an order to pay support but until he is released she will not get anything. but he will have to pay arrears for the time he is in jail. If he doesn't have a job the judge should give him so much time to get one. in the mean time she should be able to get assistance from her local welfare office. tell your sister to hang in there, it is a long bumpy ride for a little bit, but the system will work for her she just has to be a little patient. good luck
