My husband is not allowed near me,kids or the house..we have a PPO in place (Protective Order) due to his threats and anger. He told the sheriff the other day that that he will make me sell the house and he wants %50. My question is.. Can I try to buy him out or can he force the selling issue? I have 6 children and wanted to talk to the lawyer about getting 60/40 instead of 50/50. is that hard to get? My soon to be ex-husband is a very spiteful and angry man.. can he bark and complain enough to still control everything in the divorce?

Most assets like a house are 50/50. He can't make you sell it if you are willing to 'buy him out'. If you can't afford to buy him out you may be forced to sell the house. But then again there's the 6 children to consider. Hubby is going to take one hell of a hit in the child support dept (if all six are yours together). You're not going to get everything you want but neither is he. If you do go 60/40 or higher, then you may have to take less in child support. I'm sure a lawyer can advise you better than I.

I dont know VA, but I know that if one wants to keep it they have to buy out the other. In the end it really depends on who has the better lawyer. You should keep the house because of the kids and with his stuff on him you should win...
consult a lawyer, they have consultations for free......good luck
