It shouldn't be illegal, its the thieves fault if they die. The homeowners or buisness owners shouldn't be at fault.

So your fine with the fact that a brave fireman coming to pull your a$$ out of the burning building gets shot by your booby trap? Use you brain and you can see why this is an illegal practice.

The real answer is the Courts decided that life was more valuable than property. Theory is that you can replace property, not life. I understand that a criminal should get what he deserves, but the Courts decided a long time ago in a case where some gusy kept stealing old jars from a barn that rigging a shotgun up probably wasnt the best idea. One guy got his legs blown off over some jars. Anyway. I say screw him. If he wasnt there stealing, it wouldnt have happened. Courts didnt see it that way. This would be the same Courts that believe retarded people should be allowed to have chilfren too.

Because thiefs are the only ones coming through your doorway - police, paramedics, fire personnel. For example, a policeman had to enter a home where it was reported someone died of natural causes - if the door was rigged with the shotgun, it would have/could have killed the officer. This is not the reason that was given though when the Judge issued his opinion from the actual court case ( don't know name now ) that the scenario comes from.

Because when the firefighter is rushing in to put out the fire in your house, and the gun goes off...it's not a good thing.

Its illegal not because it might kill a thief, but because it might kill someone else, in which case it would be considered negligent homocide.

Because you can't kill someone just for breaking in your home, you would be violating the criminals rights
