Frankly, other than the fact that few of the restaurants (McDonald's and other franchises) rarely clean the ball pits and you know how clean kids can be, there's nothing threatening about them. I have noticed that several of the restaurants that did have them have replaced them with something else.

I would never put my child in one of those bacteria virus factories. Totally unsafe anywhere. If you buy a pool and order the balls over the net you can make your own. Put a fence around it and only let in children you trust. And they must have a parent present. Put a hard cover over it securely when not in use and to clean use a net cover fill with water and bleach, stir till done. Use the net to collect the balls and let them air dry.
We shouldn't keep our kids to clean. Exposure to some virus' allows the immune system to develop and keeps the really bad bugs from hurting them permanently.
No sick kids, clean clothes, clean hands, no food or drinks, no drooling babies.

I live near DC and one of our local McDonald's had to close down it's play place because a little boy got stuck with a hypodermic needle while he was playing in the ball pit.

our mickyds ball pit was closed for 24 hours after a snake was found in it. Luckily nobody was bit and I don't believe it was poisonous. But it could be the next time.

If McDonald's ball pits are unsafe, so are all the others everywhere else.
