I would assume that the framers of the Constitution had seen governmental abuse through cruel and unusual punishment as well as ridiculously high bail amounts, or they would not have included it in the Bill of Rights.

Well instead of the death penalty being an option there would just be more people in jail until they die of natural causes,or killed while in prison.The death penalty gives justice,but at the same time is being put to death worse then being in prison for life? I don't think so.
