If you can legally film her in the nude and in sexual activity... you really think there would be laws against videotaping the feet?
How do you know the woman did not consent to the filming?
Was it done in a public place? Common law countries (UK and USA at the fore) are notoriously not too keen on protecting people's privacy, or image rights... so if it was in a public place rather than invading the privacy of a home, I guess the guy is home free.

I think it should be and i'm pretty much sure it is without her permission. i was once walkin by this cafe that had those high bar stools near the window, this woman was sat having her coffee or whatever and this freaky guy outside the window had his digital camera out taking photo's or makin a mini video...needless to say she soon moved when she saw him doin it.

Public domain means exactly that -- PUBLIC. To use such images commercially for financial gain requires a model release, however, pictures of feet would be very hard to distinguish identity in a court.
