i moved into this house in august the first couple of weeks were fine then the landlords druggie son the maintnace man started harasseing us he tried to fight my husband for no reason he starts working on something never finishes it and leaves his work stuff all over our yard his kids play in our yard and trash it and him himself throws beer can in our yard and the bed of our truck.repairs are needed on the house and was suppose to be fixed month ago the roof leaked and ruined our mattress and box springs when we went to complain about this the landlord told us that hes giveing us until the first to move out we never been late on the rent or violated the lease i know he needs a court order to evict us should i take legal action on this guy?

yes u should
that guy has no right to terminate u
u seem like a good person,
and u should take his son to court to
just becuz hez the land lord or the son
dont mean he can leave stuff in ur yard
or let his kids play on ur property
ur paying for this house, u have every
to take his *** to court
plus when he tried to fright ur husband for no reason
then u should have called the cops
and he could have been arrested for harrasment
dont let ppl walk over you like a door mat
u need to haul both of their asses to court
and i garuntee u will win!!!!!

Well if you don't have the money to get out now, I would take it to court. If nothing else, it'll buy you some time with all the court proceedings and all. In the meantime, I'd call the housing authority in your area. I would also take other legal action against him in order to get some money out of him for ruining your mattress and box-spring! Talk to the police to see if there's anything that can be done about the druggie son, they may want to know of his comings and goings. You may want to talk to the neighbors about this, but be careful they may know him and tell him whatever you say to them. GOOD LUCK!!!!!!!!

ABSOLUTELY. Look on the internet, try to find the tenants rights for your state. YOU HAVE RIGHTS. I would definatey pursue this - don't let him, or his son, walk all over you like that. Regardless that you do not own the property - you are living there, you are PAYING to live there. I urge you to find tenants rights - if you can't, then call a lawyer (maybe call your town municipal building, they might have someone that can tell you the laws). AND - tell him you want your bed replaced because his lack of repairs to the roof destroyed it - if he refuses, SUE him. Don't be a doormat - that's what he's counting on! As long as you've never been delinquent on the rent, or violated the lease in any way, then he has NOTHING to stand on!! Good luck to you - you WILL win this one!

Definitely, he is violating the lease agreement and obviously has not idea on being a landlord. I say take him to small claims court and at least get your money back if not a little compensation. Then move!

By all means take legal action on him, take pictures of the damage to your property, and in the mean time, be looking for another apartment, document everything, even record, some of the things he says to you, you have got to have proof! Call the housing inspector, on the landlord!

no, just get the heck out. If you do go to court, it is a long, painful process, that will in the end cost you more money than what it would take you to find another place. Not only that, why do you want to stay in that enviorement and fight to stay there, when it causes more stress on you and endagers your children. GET OUT NOW!!!

Would cost less if you moved out instead of bringing them to court and it sounds like its not a safe place to be raising children :-)
